The Case filled by Comr. Abdulraman Agboola and Murtala Mohammed Garba, challenging the Consent JUDGMENT given by the Nasarawa High Court, that declared the purported PORTHARCOURT, Gombe and Abuja Congresses Null and Void, came up today, Thursday, February 25, 2021.
The Counsels were as follows;
1.BARR C. OGALAGU ( FOR CADA).
- BARR CHUKWUEMEKA JOSEPH AND MICHAEL OGOBUCHI (FOR BOT-NYCN).
- BARR A. MUKTAR (FOR AGBOOLA AND MURTALA)
- BARR PETER ULOFU (FOR CHIEF AZUGBENE BOT).
The Court insisted it has no power to hear all the Motions filed by Agboola & Murtala and that there is a valid Consent Judgement already given, that they should go and appeal against it if they are not satisfied with it.
The Judge also said he does not have the power to even hear the Motion for Joinder filed by Chief Azugbene’s lawyer , on the ground he was not a Party to the original suit, the Judge described the Chief AZUGBENE’S Lawyer as “a mere busy-body in this Matter”.
The Judge further said that he would want the Lawyers of Prof. Akoh Board and CADA to officially move him to strike out the whole Motions by the next adjournment.
The Implication is that the Consent Judgement which dissolved Sukubo’s NEC remains valid, potent and can only be appealed against. Until it is set aside by the Appeal Court, the Consent Judgement remains valid.
CASE WAS ADJOURNED TO 6TH MAY, 2021.
It would be recalled that the youtHouse reporters published the News of this Consent Judgment that Nullified all Congresses held against an Order of the Honourable Court, while a substantive suit was equally pending the before the Court over the NYCN matter.
In the Consent JUDGEMENT, the Court had mandated the Prof. Akoh Board to set up Congress Planning and Electoral Committees to conduct a credible National Election to produce a unified NEC, While setting up mechanism to review the NYCN Constituion.
With this Consent JUDGEMENT standing, in addition with the Order of the Federal High Court Abuja, it means Comr. Sukubo has no legal standing as President of the National Youth Council of Nigeria, until these JUDGMENT and Order are vacated.
